Terms of Service
Overview
This website is operated by EDC Fidgets Australia, an Australian business operated as a sole trader. Throughout the site, the terms “we”, “us” and “our” refer to EDC Fidgets Australia.
By visiting our website and/or purchasing something from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy and Returns & Refund Policy.
These Terms apply to all users of the website, including browsers, customers and purchasers.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
1. Online Store Terms
By using this website, you confirm that you are legally capable of entering into a binding agreement.
You must not use our products or website for any unlawful or unauthorised purpose, or violate any applicable laws in connection with your use of our website.
You must not transmit viruses, malicious code or other material that could damage or interfere with the operation or security of the website.
2. Products
We specialise in EDC (Everyday Carry) products, including fidget sliders, fidget rings, fidget spinners and related accessories.
We make reasonable efforts to display product descriptions, specifications, materials and images as accurately as possible.
Actual colours and appearance may vary slightly depending on lighting, photography, screen settings, manufacturing batches and the characteristics of materials used in the product.
Natural or machined materials such as titanium, copper, brass and other metals may develop patina, surface marks or changes in appearance through normal handling and use. These characteristics are not necessarily defects.
Nothing in this section limits your rights under Australian Consumer Law if a product is faulty, damaged, not as described or otherwise fails to meet a consumer guarantee.
3. Product Availability
All products are subject to availability.
We make reasonable efforts to keep stock information accurate. However, occasionally an item may become unavailable after an order has been placed.
If we are unable to supply an item you have ordered, we will contact you and provide an appropriate solution, which may include a refund for the unavailable item.
4. Prices
Unless otherwise stated, all prices displayed on our Australian store are in Australian Dollars (AUD).
Where applicable, prices include Goods and Services Tax (GST).
We may change product prices from time to time. Any price change will not affect an order that has already been accepted and paid for, except where required or permitted by law.
Shipping costs, where applicable, will be displayed during checkout before you complete your purchase.
5. Orders
When you place an order, you are making an offer to purchase the products in your order.
After placing an order, you may receive an automated order confirmation. This confirms that we have received your order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product information error;
- payment cannot be successfully processed;
- we reasonably suspect fraud or unauthorised payment activity; or
- we are unable to fulfil the order for another legitimate reason.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order to the original payment method.
6. Payment
Payment must be made using one of the payment methods available at checkout.
Depending on availability, payment options may include credit or debit cards, PayPal, Shop Pay, Apple Pay, Google Pay or other payment providers.
Payment information may be processed by third-party payment providers. Their own terms and privacy policies may also apply.
You agree to provide current, complete and accurate billing and payment information when making a purchase.
7. Shipping and Delivery
Orders are shipped according to our Shipping Policy.
Any delivery timeframes displayed on our website are estimates unless expressly stated otherwise.
Delivery times may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, public holidays and other disruptions.
If there is a significant problem or delay with your order, please contact us so that we can investigate.
Nothing in this section limits any rights you may have under Australian Consumer Law.
8. Returns, Refunds and Exchanges
Change-of-mind returns are governed by our Returns & Refund Policy.
Our change-of-mind policy is separate from your statutory rights under Australian Consumer Law.
If a product is faulty, damaged, not as described or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy under Australian Consumer Law.
Please refer to our Returns & Refund Policy for further information.
9. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable legislation where doing so would be unlawful.
10. Intellectual Property
Unless otherwise stated, the content of this website, including text, graphics, website design, logos and original photographs created by us, is owned by or licensed to us and is protected by applicable intellectual property laws.
Third-party brand names, trademarks, product names and logos, including those belonging to manufacturers and brands whose products we sell, remain the property of their respective owners.
The sale of a third-party branded product by us does not transfer ownership of any intellectual property associated with that brand.
You may not reproduce, distribute, modify or commercially exploit our original website content without our prior written permission, except as permitted by law.
11. Product Use
Our products should be used responsibly and for their intended purpose.
Some products may contain small parts, magnets or metal components and may not be suitable for young children.
Please follow any safety information or instructions supplied with the product.
To the extent permitted by law, we are not responsible for loss or damage resulting from misuse, unauthorised modification or use of a product contrary to supplied instructions.
Nothing in this section limits liability that cannot lawfully be excluded under Australian Consumer Law.
12. Third-Party Services and Links
Our website may contain links to third-party websites or use third-party services such as payment processors, shipping providers and ecommerce services.
We are not responsible for the content, availability or practices of third-party websites that we do not control.
Your use of third-party services may also be subject to the terms and privacy policies of those providers.
13. Website Information
We make reasonable efforts to ensure information on our website is accurate and current.
Occasionally, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions or other information.
Where an error occurs, we may correct the information as soon as reasonably practicable.
Nothing in this section permits us to avoid obligations imposed by Australian Consumer Law, including obligations relating to misleading or deceptive conduct.
14. Prohibited Uses
You must not use this website:
- for unlawful purposes;
- to infringe intellectual property rights;
- to transmit malicious software or harmful code;
- to attempt to gain unauthorised access to the website or associated systems;
- to collect or misuse personal information belonging to others;
- to interfere with the security or operation of the website; or
- to engage in fraudulent activity.
We may restrict access to the website where reasonably necessary to protect the website, our customers or our business.
15. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from the use of our website or products where such liability may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot be excluded under Australian law.
16. Privacy
Your personal information is handled in accordance with our Privacy Policy and applicable Australian privacy laws.
Please review our Privacy Policy for information about how we collect, use, store and disclose personal information.
17. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our business, website, products or applicable laws.
Any updated Terms will be published on this page and will apply from the date they are published.
Changes will not retrospectively remove rights or remedies that have already arisen under an existing purchase.
18. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as severed to the extent necessary, and the remaining provisions will continue to apply.
19. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You and we submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
